I filed and was granted injured spouse can I get a stimulus rebate?

Earlier this year I filed married joint with my new husband. We were suppose to get a $6690 return from federal taxes however because of some old student loans they took it all. I then filed an injured spouse claim and was awarded $1531. My question is will I still qualify for a rebate or will they take all of it again to satisfy his debt. We claim 2 children under the age of 17. Please any help you could offer I would greatly appreciate it. Thanks,I filed and was granted injured spouse can I get a stimulus rebate?

They will steal the money again. The alleged debt is still outstanding and the IRS will send the money to the U.S. Dept of ';Education';. You need to fill out the IRS Form 8379 in order to get half of what you are eligible for. As an injured spouse previously, you both work, hence, you could 900 {1800 \ 2}.

IRS: Q. I'm eligible for a payment but I still owe federal income tax from a prior year. Will my payment be reduced?

A. Yes. For this purpose, the stimulus payment is treated like any other tax refund. This means that part or all of your payment can be used to pay past-due federal or state income taxes or non-tax federal debt such as student loans and child support. If this occurs, you will receive a letter ex-plaining how the stimulus payment was applied.

From the IRS as of 3/25/8: Q. I am filing a joint tax return with my spouse who has a past-due obligation. How can I ensure that I still get my share of our joint stimulus pay-ment?

A. In this situation, you are considered an injured spouse. To get your share of a joint income-tax refund, as well as your share of the stimulus payment, you can file Form 8379, Injured Spouse Allocation. You will get your share of these payments, and your spouse鈥檚 share will be applied to his or her past-due federal or state income taxes or non-tax federal debt such as student loans and child support. Your allocation request will be processed more quickly if you attach Form 8379 to your regular 2007 federal income tax return. [New 3/25/08]
Yes! The stimulus monies that are being disbursed, the injured spouse is entitled to 1/2 the money. However, you will have to fill out an injured spouse form and mail it in.

Any time you get a letter from an entity stating they have confiscated your return of any kind, you have so much time to fill the injured spouse form. Then, the company that has the lien cannot do anything with the money for 6 months until your form is granted.
