I am trying to find out if someone who came to the country by marriage can be deported if the spouse dies?What happens to non citizens when there spouse who is a citizen dies?
Hi! This depends on the status of the person. If they are legally a permanent resident, then I believe they can continue to reside so long as they keep their green card updated and are able to financially support themselves. They can really only be deported if they fail to keep in touch with INS or get into trouble with the law. Not if the conditions on their green card are past.
If they have status and have filed for legal status before the death, they will continue to have status as long as they keep up with the paperwork and don't let it lapse. Permanent legal resident is just that...permanent...as long as the rules are followed. They can apply for citizenship when their waiting period is over.
