First of all, the divorce papers stipulate one year. Was the insurance company notified of that stipulation in the divorce papers? If this insurance card is through the ex husband's employer, then that person must notify their company to cancel the second card - simply put remove the ex wife from their insurance. The company may request a copy of the divorce papers to prove the request. Until that time, the insurance card is still active and if she does not pay the co-pays the ex husband will be liable for those payments. Good Luck
As soon as the divorce was final, it was the husband's responsibility to provide a copy of the divorce decree to either his employer's HR department if his insurance was employee based, or to his insurance company if he carries his own. Send a copy of the divorce decree with a dispute letter to the insurance company. They will then go after HER for payment because she's using the insurance fraudulently....bad move!
